Howdy Texans! The Senate once again is debating bankruptcy as a prelude to appointing conferees. One of the major sticking points is the homestead cap included in the Senate bill. The Senate bill caps the homestead exemption at $125,000 regardless of where the debtor lives. Proponents of the cap were particularly outraged by the recent Florida Supreme Court decision in which it was held that a home is protected from creditors, even when the homestead is “acquired by a debtor with the specific intent to hinder, delay or defraud creditors.”
Texas Senator Kay Bailey Hutchison opposes the homestead cap on the grounds that it interferes with states’ rights and violates the Texas Constitution. She may offer an amendment next week or otherwise try to get changes in the bill to gut the homestead cap. She may be interested in hearing from Texans on the need to protect and defend the Texas homestead.
PLEASE CALL HER TO PROTECT OUR TEXAS HOMESTEADS. Many people have more than $125,000 equity in a home that are not rich, including retired and elderly people, small farmers and ranchers, etc. Your opinion counts!

If you call, let them know that you heard that the bankruptcy bill is back on the floor and that as a Texas resident, you are opposed to the homestead cap. Please let other Texans know about this so that they can make their views known on such an important issue to the State.
