There is a new law pending in Congress that would allow Bankruptcy Judges to change the terms of mortgages of people in Chapter 13 bankruptcy. This could allow you, for example, to file a Chapter 13 bankruptcy, and propose a Chapter 13 plan to change your “Adjustable Rate Mortgage” or ARM to a fixed rate mortgage at a reasonable interest rate.
If you are in favor of this law, please call your Congressman or Congresswoman. In the House of Representatives, the bill is known as H.R. 3609. In the U.S. Senate, the bill is known as S. 2136. To find out who your Member of Congress is, go to http://www.house.gov. At the top of the page, you can enter your zip code and it will tell you who your Member of Congress is. The names of your Senators can be found at www.senate.gov.
